Johannes Stauffer registered a will on 30 Dec 1766 at Lancaster County, Pennsylvania, which read:
In the Name of God Amen. I John Stauffer of Warwick Township being very sick in Body but of sound memory and good sense Thanks be unto God therefore calling unto memory the mortality of my body do make this my Last Will and Testament in manner as followeth Imprimis I ordain and it is my form will that all my just debts shall be paid by my Executor hereafter mentioned out of my moveable Estate and if said my moveable Estate should not be sufficient for all said my debts to satisfy then I ordain and it is my will that my Executor shall sell so much of my Real Estate and at such place where they think proper as will answer for the residue of paid my debts for which reason I impower them to give good Lawful deeds for said piece of Land is sold from my real Estate which I hereby acknowledge as Lawful as if done by myself Farther I ordain that all my messuage Plantation shall be divided in two equal shares according to the Quantity of Acres and one moiety thereof to be given to my son Christian the other moiety to my Son Jacob said my land shall by valued and divided and to each of my Sons his share appropriated by fair arbitrators indifferently chosen by my Executors and said my two sons my oldest son Christian shall have that moiety where on my house barn and stable is and my son Jacob shall have that moiety wheron I now do live Each of my Sons shall pay to my heirs for his moiety the sum of six hundred Pounds Lawful money of Pennsylvania but my eldest son Christian shall pay above that said sum so much more as said fair Arbitrators shall value said his moiety higher as the other moiety of my son Christian because he had received in his share all buildings except that where I do live now and this over plus he shall pay to my Son Jacob And further I ordain that my two sons Christian and Jacob shall from one hundred and fifty Pounds (being part of the aforesaid consideration money) shall pay Lawful Interest to my beloved wife during all the Time of six year next following my death and shall build her a house in some fit place of my premise fit for her use at their charges and shall give her that part of the meadow at the East side of Forge Creek which I now have in my use and shall farther build her a stable fit for one Cow and shall fence in a garden sufficient for her use and shall carry home all her firewood and my beloved wife shall have at the expiration of said six years from my said two sons the lawful Interest from one hundred Pounds during the time of her Widow hood and after said six years are expired my said two sons shall pay said fifty Pounds to my heirs Farther I ordain that my beloved wife when she shall marry again shall quit all the aforesaid benefits and privileges and shall then receive from my said two sons within the Term of a half year after her marriage the sum of eighty Pounds money aforesaid and shall then by a Lawful discharge quit all her claims to my estate both real and personal and then ?????? of said one hundred and fifty pounds shall return to my heirs. Further I ordain that each of my two sons aforesaid shall pay from said considerations money every year to my heirs the sum of twenty five pounds money aforesaid to begin after a year after my death is expired and it is my firm resolution that all my children shall have divided all my estate real and personal among their six equal shares and I bequeath to my eldest son Christian the sum of five pounds money aforesaid to be paid to him after a year after my death is expired under this restriction that he shall content himself to have an equal share with his co-heir Further I ordain that my four eldest children (Christian and Jacob included) shall have the payment of the first year due by my two sons and the second year the four next in age and so forth And further I ordain that my Executors or any of those then living shall give good Lawful money ??? to my respective sons for paid my Land when they shall have paid for the above consideration money or given good security for the residue unpaid to hold said my Premises to them their heirs and assigns for ever and such conveyances shall be as valid as if done by itself And further I ordain that if my two sons or any of them should refuse to accept said my premises under the aforesaid considerations my executors shall hereby be impowereed to sell said my premises or one moiety thereof so as occasion shall require for the ??? they can get and shall bestow the money arising from thence to the aforesaid uses And I impower them thereby to sign good deeds for said my premises which deeds I acknowledge as done by myself Further I bequeath to the poor of our congregation the sum of five pounds money aforesaid to be distributed to them by Abraham Brubaker and paid unto him within one year after my death. IN THE NAME OF GOD AMEN. I Jacob Stauffer of the Township of Rapho in the County of Lancaster and State of Pennsylvania weaver am sick at present but of sound mind memory and understanding thanks be to God for the same Calling unto mind the mortality of my body knowing that it is appointed for all flesh once to die, DO make and ordain this to be my last Will and Testament, in manner following First of all I recommend my soul into the hand of God who gave it, and my body I recommend to be buried in a Christian like and decent manner, and as touching such worldly Estate wherewith God hath pleased to bless me with, I give and devise & bequest in manner following, PRINCIPALLY and first of ordering I allow and order that all my just debts and funeral expenses be paid off and satisfied out of my Estate, what may be left after my decease as soon as conveniently may be done by my hereafter named Executors. Item it is my will that my wife Anny shall keep all what she now hath in her Custody being the full one third of my whole Estate which shall be deemed and she shall have that all for her full dower and third cut of my Estate as she hath freely Consented thereto, ITEM the remainder of after my debts is paid as aforesaid shall be divided to and among my four Children, to wit, Anny, John Jacob and Barbara in such a manner, my daughter Anny who is intermared with John Flory and my son John shall first and foremost take and divided to and among themselfs in equal shares all my personal Estate Horse wagon plough Staff and all my house and kitchen furniture weaving loom and geers whatsoever moveable my watch I allow my daughter Anny shall have it in part of her share in the said division, and my daughter Barbara shall have the watch which I have at Lancaster in forhand and all my money Bonds and Outstandings debts shall be equally devided into four shares for my said four children, AND LASTLY I nominate Constitute and appoint my son John and my son in Law John Flory to be my Executors of this my last Will and Testament and my Executors shall also be Guardian over my youngest daughter Barbara until she attains her age of eighteen years, disanulling and making void all former Will and Wills Testament and Testament by me heretofore made ratifying and Confirming this and no other to be my last Will and Testament IN WITNESS whereof I Jacob Stauffer have hereunto set my Hand and Seal the second day of May in the year of our Lord one thousand seven hundred and ninety eight
